CIVIL LITIGATION DIVISION

Objective

To provide expertise and services to the Government on litigation of civil matters.

Functions

The Division will perform the following functions:-

  • To advice the Government on litigation of civil matters, including on human rights and constitutional matters;
  • To conduct civil litigation, constitutional matters, human rights cases, election petitions and related matters instituted in court by or against the Government within and outside Tanzania;
  • To review and draft documents concerning cases filed or to be filed in courts of law and tribunals;
  • To prepare and institute suits/claims/petitions in the High Court and Court of Appeal on behalf of the Government;
  • To provide legal expertise to the Government, on the preparation, formulation and litigation of civil cases;
  • To intervene in any Court proceedings to protect and defend the interest of the Government on civil litigation; and
  • To prepare bi-annual report on matters and functions performed by the Division according to the agreed format and submit to the Solicitor General.

The Division will be led by a Director and will comprise three (3) Sections as follows:-

(i) INTERNATIONAL CIVIL LITIGATION SECTION

The Section will perform the following activities:-

  • Conduct litigations of civil cases in judicial and non-judicial bodies outside Mainland Tanzania;
  • Intervene in any civil proceedings conducted in judicial or quasi-judicial bodies outside Mainland Tanzania for purposes of protecting and defending interests of the Government; and
  • Advise the Government on all civil matters that are conducted or about to be conducted outside Mainland Tanzania.

This Section will be led by an Assistant Director.

(ii) DOMESTIC LITIGATION SECTION

The Section will perform the following activities:-

  • Conduct civil litigation in judicial and non-judicial bodies in Mainland Tanzania;
  • Intervene in any civil proceedings conducted in judicial or quasi-judicial bodies in Mainland Tanzania for purposes of protecting and defending interests of the Government; and
  • Advise the Government on all civil matters that are conducted or are about to be conducted in Mainland Tanzania

This Section will be led by an Assistant Director.

(iii) CONSTITUTIONAL,HUMAN RIGHTS AND ELECTION PETITION SECTION

The section will perform the following activities:-

  • Conduct litigation of constitutional and human rights petitions filed various forums within and outside Tanzania to defend the interests of the state;
  • Conduct litigation of election petitions filed in judicial bodies for purposes of protecting and defending the interests of the Government; and
  • Provide advice the Government on all constitutional, Human rights and election petitions filed or conducted in various forums.

This Section will be led by an Assistant Director

CASE MANAGEMENT AND QUALITY ASSURANCE DIVISION

Objective

To coordinate and ensure effective case management and ensure quality assurance.

Functions

The Division will perform the following functions:-

  • To receive and work on reports on civil litigation, including human rights and constitutional matters, that are in courts of law and arbitrary proceeding in the arbitrary tribunals related on matters to which the Central Government, Independent Department, Executive Agency or Local Government is a party or has interest and advise;
  • To set civil litigation standards geared towards raising quality assurance delivery;
  • To receive and submit bi-annual reports on matters related to civil litigation, including human rights and constitutional matters, and arbitration to the Solicitor General;
  • To coordinate, monitor and evaluate the performance of Law Officers, State Attorneys Officers or staff in civil litigation and arbitration and advise the Solicitor General;
  • To coordinate and supervise the quality assurance standards set by the Office of the Solicitor General;
  • To maintain data base on civil cases and arbitrary proceedings handled by the Office of the Solicitor General countrywide;
  • To receive reports on civil litigation and arbitration to, and from the office of the Solicitor General to be submitted to the Minister and Attorney General;
  • To provide a link between the Office of the Solicitor General and other Government institutions representing interests of the Government in judicial or quasi judicial bodies;
  • To coordinate effective case management in relation to civil litigation and arbitration;
  • To liaise with MDAs and LGAs on anticipated civil or arbitral proceedings, pending civil litigation or arbitral proceedings filed in court or arbitral tribunals and or finalized civil litigation or arbitral proceedings to which the Government is a party or has interests and advise; and
  • To prepare bi-annual report on matters and functions performed by the Division according to the agreed format and submit to the Solicitor General.

The Division will be led by a Director and will comprise two (2) Sections as follows:-

(i) COORDINATION AND CASE MANAGEMENT SECTION

The Section will perform the following activities:-

  • Coordinate and monitor civil litigation, including human rights and constitutional matters, in courts of law on matters to which the Central Government, independent department executive agency or local government is a party or has interest;
  • Supervise case management in relation to civil litigation and arbitration;
  • Prepare and submit bi-annual reports on matters related to civil litigation to the Director;
  • Maintain register of civil cases filed by or against MDAs and LGAs;
  • Collect and analyse reports on civil litigation to, and from the office of the Solicitor General and advise the Director This section will be led by an Assistant Director; and
  • Communicate with MDAs and LGAs on anticipated, pending or finalized civil suits to which the Government is a party or has interests and advise the Director.

This Section will be led by an Assistant Director.

(ii) QUALITY ASSURANCE SECTION .

The Section will perform the following activities:-

  • Supervise the implementation of quality assurance in civil and arbitration;
  • Coordinate arbitrary proceedings in the arbitrary tribunals on matters to which the Central Government, independent department executive agency or local government is a party or has interest;
  • Prepare and submit bi-annual reports on matters related to arbitration and submit to the Director;
  • Maintain register of arbitrary proceedings filed by or against MDAs and LGAs;
  • Collect and analyse reports on arbitration proceedings to, and from the office of the Solicitor General and advise the Director; and
  • Communicate with MDAs and LGAs on anticipated, pending or finalized arbitrary proceedings to which the Government is a party or has interests and advise the Director.

This Section will be led by an Assistant Director.

ARBITRATION DIVISION

Objective

To provide expertise and services to international and local arbitration.

Functions

The Division will perform the following functions:-

  • To conduct, handle and coordinate the conduct of arbitration by or against the Government arbitrarily bodies both within and outside Tanzania;
  • To advice the Government and other public institutions on matters relating to arbitration's;
  • To intervene in any arbitration proceedings to protect and defend the interest of the Government; and
  • To prepare bi-annual report on matters and functions performed by the Division according to the agreed format and submit to the Solicitor General.

This Division will be led a Director and will comprise two (2) Sections as follows:-

(i) INTERNATIONAL ARBITRATION SECTION

The Section will perform the following activities:-

  • Conduct arbitration proceedings in arbitrary bodies outside Mainland Tanzania;
  • Intervene in any arbitration proceedings conducted in arbitrary bodies outside Mainland Tanzania for purposes of protecting and defending interests of the Government; and
  • Advise the Government on arbitration proceedings that are conducted or about to be conducted outside Mainland Tanzania.

This Section will be led by an Assistant Director.

(ii )DOMESTIC ARBITRATION SECTION

The Section will perform the following activities:-

  • Conduct arbitration proceedings in Mainland Tanzania;
  • Intervene in any arbitration proceedings conducted in arbitration bodies in Mainland Tanzania for purposes of protecting and defending interests of the Government; and
  • Advise the Government on all arbitration proceedings that are conducted or are about to be conducted in Mainland Tanzania.

This Section will be led by an Assistant Director.

ADMINISTRATION AND HUMAN RESOURCE MANAGEMENT DIVISION

Objective

To provide expertise and services on human resources management and administrative matters to the Office.

Functions

The Division will perform the following functions:-

  • To advice the Deputy Solicitor General on administrative and human resources matters;
  • To provide strategic inputs to management on administration and human resources management issues such as recruitment, human resources development and training, promotion, retention, motivation, performance management and welfare;
  • To process terminal benefits and leave;
  • To ensure optimal efficient and effective management and utilization of human resources in the Office;
  • To link between the OAG and the Public Service Management Office on operationalization of the Public Service Management and Employment Policy and laws governing public service;
  • To provide data support and up-date records on various human resources information; and
  • To collect, analyse, store and disseminate data and information related to human resources development plans.

The Division will be led by a Director and will comprise of two (2) Sections as follows:

(i) ADMINISTRATION SECTION

The Section will perform the following activities:-

  • Interpret and enforce principal legislation governing the public service including regulations; standing orders, other labor laws, circulars and guidelines;
  • Facilitate employees relations and welfare including health, safety, sports and culture;
  • Provide registry, office records, menegerial and courier services;
  • Handle protocol matters;
  • Facilitate provision of security services, transport and general utilities;
  • Facilitate general custodian services including maintenance of office equipment, buildings and grounds;
  • Coordinate implementation of ethics and value promotion activities including prevention of corruption practices;
  • Implement diversity issues including gender, disability, HIV/AIDS and Non-Communicable Diseases and be the Office’s Gender Focal Point;
  • Administer the implementation of Business Process Improvement;Advise on organizational efficiency of the Office;
  • Administer the implementation of Client Service Charter; and
  • Administer implementation of Private Sector Participation.

The Section will be led by a Principal Administrative Officer.

(ii) HUMAN I RESOURCE MANAGEMENT SECTION

The Section will perform the following activities:-

  • Coordinate staff recruitment, selections, placements, confirmations and transfers;
  • Facilitate human resource training and career development (professional development, skills enhancement performance improvement, pre-retirement, part-time, and overseas);
  • Facilitate orientation or induction programe for the new entrants;
  • Carry out human resources planning to determine supply and demand needs for professionals;
  • Administer salaries and process payrolls;
  • Process and update records of various leaves such as annual, sick, maternity, study and terminal;
  • Oversee employees benefits(pension,allowances etc)and entitlements;Serve as a Secretariat to the employment Committee;
  • Coordinate implementation of Open Performance Review and Appraisal System (OPRAS) and prepare implementation reports;
  • Prepare Annual Personnel Emolument Estimates;
  • Prepare and facilitate implementation of succession plans;
  • Carry out training needs assessment for the office and prepare training programs;
  • Monitor and evaluate implementation of institutional training programs and prepare training reports;
  • Carry out impact assessment of the training programs and prepare assessment reports;
  • Coordinate the preparation and implementation of the Wage Bill and Recruitment; and
  • Initiate and co-ordinate in–house courses and on the job training.

The Section will be led by a Principal Human Resources Officer.

PLANING DIVISION

This Division will be lead by Director and will comprise of two ( 2) Sections;-

(i) Planning and Budgeting section

(ii) Monitoring and Evaluation section

(i) PLANING AND BUDGETING SECTION

This Section will perform the following activities

  • Coordinate formulation and preparation of annual plan and medium term strategic plan;
  • Compile office projects, programes, Action Plans and develop strategies for resource mobilization;
  • Liaise with Ministry of Constitutional and Legal Affairs, Ministry of Finance and Economic Affairs and PO-PSM on Strategic Planning and budgeting process;
  • Provide technical guidance and support for institutionalization of strategic planning and budgeting process;
  • Participate in analysis of outsourcing of non-core functions (Private Sector Participation); and
  • Prepare memorandum of understanding for projects and programs for international financing.

This Section will be led by a Principal Economist/Planning Officer.

(ii) MONITORING AND EVALUATION SECTION

This section will perform the following activities

  • Monitor implementation of Annual Plan and Medium Term Strategic Plan;
  • Prepare periodic performance reports;
  • Collect, study and analyse statistics needed in the formulation and implementation of policies, plans and budgetary proposals;
  • Provide inputs in preparations of plans, programmes and budgetary activities including establishment of performance targets and indicators;
  • Provide technical support including institutionalization of monitoring and evaluation process;
  • Undertake research and impact assessment studies of plans, projects and programmes;
  • Undertake service delivery surveys to collect stakeholders/clients views and opinions on services rendered; and
  • Coordinate mid-year and annual performance review.

This Section will be led by a Principal Economist/Planning Officer.
